Terms and Conditions

1. Interpretation and variation

1.1 In the Terms and Conditions the following definitions apply:
"Company" means Jennifer Snabel trading as “Go with the flow yoga”
"Client” means any person that has completed and submitted the booking and registration details (“Registration Form”) either in person, or online (or over the phone with the Company filling in all details) and which registration has been accepted by the Company.
"Studio" means any place provided by the Client and/or the Company for the practice of the yoga.
"Terms and Conditions" means these terms and conditions.

 1.2 References in the Terms and Conditions to the singular will include the plural and vice versa and references to the masculine gender will include references to the feminine gender.

1.3 The Terms and Conditions are incorporated into the Registration Form and purchase of class passes.

1.4 The Company reserves the right to vary and revoke the Terms and Conditions from time to time which variation it may consider necessary or desirable for the regulation of the affairs of the yoga services. Any such changes will be notified to Clients and, until revoked, are and will be binding on Clients.

1.5 The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

2. Membership

 2.1 Subject to condition 2.2, when a person has completed the Registration Form he or she will become a Client.

 2.2 Acceptance of a person as a Client is in the absolute discretion of the Company.

 2.3 The Company reserves the right to no longer work with a Client or refuse to renew the bookings of any Client whose conduct is or may, in the Company's reasonable opinion, be injurious to the character or reputation of the Company and/or the yoga or which amounts to a breach of these Terms and Conditions. Anyone so expelled will forthwith cease to be a Client of the Company.

 2.4 If a Client (with the Company’s permission) brings a guest to the Studio for a session that guest must before the commencement of the relevant session become a Client in accordance with and subject to the Terms and Conditions.

3. Minors

3.1 Children under the age of 16 may only use this website and the yoga and massage services provided by the Company if accompanied by an adult.

 4. Payments Terms

4.1 Details of session prices are available either at www.gowiththeflowyoga.co.uk and will be such prices as determined by the Company from time to time.

4.2 A Client may not attend any session at the Studio without first booking and or paying for the relevant session. The fee can paid in advance by a) pay pal, b) direct bank transfer, or cash paid to the instructor at the beginning of the class.

4.3 If any payment whatsoever under this Contract remains outstanding beyond the due date the Company may add to the outstanding sum to be collected the reasonable and necessary costs incurred by us in employing a third party to collect the outstanding sum.

 4.4 Bookings are non-transferable without the Company’s prior approval.

4.5 Subject to any statutory right of cancellation, payments for sessions are non-refundable unless otherwise stated in these Terms and Conditions.

4.6 Unless otherwise stated five and six class passes are valid for eight weeks from date of purchase. Ten class passes are valid for 12 weeks from the date of purchase.

5. Bookings & Cancellations

5.1 Clients must book sessions either with the Company in person, over the phone, or via the website www.gowiththeflowyoga.co.uk

5.2 A Client can only cancel sessions due to medical reasons or a change of circumstances and this must be undertaken by a minimum of 24 hours’ notice to the Company. If the Company receives such 24 hour notice it will offer the Client a refund (where the Client has already paid or part paid), or a rearrangement of the session date / time. The Client will be charged the full fee for any classes cancelled without full compliance with this clause.

5.3 Where a Client is late the Company may at its discretion decide to cancel the class with the full fee for such class being payable to the Company, or may deliver only that part of the class as is possible within the remaining scheduled time. Where the Company instructor is late the Company will extend the scheduled class time in order to deliver the full-length class but where the instructor is more than 20 minutes late the Client will be entitled to request either a refund and/or a rescheduled class.

6. Fitness & Health

6.1 Clients are advised not to undertake yoga or receive massage without first seeking medical advice if they have concerns over their physical condition. The Company reserves the right to refuse to teach yoga and/or give massage to any Client if, in its absolute discretion, it considers that the class or treatment may endanger the health of the individual concerned.

 6.2 Clients with low/high blood pressure and/or cardiac irregularities, detached retina, HIV, very overweight or underweight or are pregnant, should not attend classes until they have written permission from their doctor. If there is any doubt, the Client should consult his doctor. Clients must notify the Company of any circumstances affecting their health, which may be exacerbated through undertaking yoga or receiving massage.

 6.3 Clients are required to follow the instructions of the instructor at all times.

7. Limitation of liability

 7.1 The Company will provide the Client with a full refund or a replacement session where the Company is unable for any reason to deliver the scheduled session. Otherwise the Company cannot be held responsible for any particular instructor and/or item of equipment not being available for whatever reason. The Company reserves the right to make alterations to the sessions, instructors, and class formats without notice and in its absolute discretion and the Company will not be liable for any loss occasioned by such alterations except insofar as such loss is by law incapable of exclusion.

7.2 It is the Client's responsibility to ensure that he or she is capable of undergoing the routine of exercises or postures provided by any programme which he or she follows in the class. Client’s accept the risk of injury from performing exercises and are advised to consult their doctor prior to beginning any session.

7.3 The Company accepts no liability for loss or damage to property of Client’s except insofar as such loss, damage or injury is by law incapable of exclusion.

 7.4 The Company does not limit its liability for death or personal injury caused by the negligence of its staff or agents, but otherwise excludes all liability to members except insofar as such loss, damage or injury is by law incapable of exclusion.

7.5 To the fullest extent permissible by law the Company hereby limits it liability to the purchase price of the session/s and does not accept any liability for indirect, consequential or third party loss and damages, or liability for any loss of data, earnings or profits, howsoever caused by use of this website or the services offered herein.

8. Dress / Equipment

8.1 Clients are requested to wear a comfortable form of dress appropriate to the practice of yoga. We recommend that Clients wear stretch pants or shorts and a T-shirt or sports top.

8.2 The Company will provide a yoga mat for the duration of the class where the Client has indicated that they do not own a mat. The Company will provide all massage equipment. The Company accepts no responsibility for the condition of the mats or equipment provided.

9. Safety & Hygiene

9.1 The Client will ensure that where they are providing the premises / space in which the yoga will be offered (“the Studio”) it is safe and hygienic and suitable for the practice of yoga and/or massage and the owner of the space will have permitted the Company’s use of such space. The Company reserves the right to cancel or terminate a class without refund where the Studio falls below this required standard.

10. General / Data

10.1 A person who is not a party to the Registration Process has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of the Registration Process.

10.2 The Company may, if a Client so wishes, communicate with the Client by email. By providing an email address to the Company, the Client consents to receiving email communications from the Company, including notices pursuant to the Terms and Conditions. The Client also accepts the risk that email may not be a secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Client by email.

10.3 Any marketing, educational or other materials of this nature whatsoever produced by the Company and which are made available to the Client will at all times remain the property of the Company and will be subject to the Company's copyright.

11. Use of cookies / Security

11.1 Cookies are small files which many websites transfer to your hard disk. They can inform the website what pages you visit, and your preferences, which enable websites to provide you with a more personalised service. You can set your browser to refuse cookies, or to warn you before accepting them. Although we use cookies, most parts of our site can be accessed even if your cookies are turned off. You may find there are parts of the site which cannot be accessed if your cookies are turned off.

11.2 How do we use your information?
We use the information to help us understand more about how our website is used, to improve our site, and to send you information about us and our products which we think may be of interest to you, both electronically or otherwise. Unless you have informed us that you do not wish to receive further information about our products and services and those of our affiliates and partners, we and they may send you direct mail.

11.3 When do we share your information?
We do not sell or pass on your personal information to others.
If we believe that your use of the site is unlawful or damaging to others, we reserve the right to disclose the information we have obtained through the site about you to the extent that it is reasonably necessary in our opinion to prevent, remedy or take action in relation to such conduct.

12.1 The company makes no warranties or representations of any kind concerning the accuracy or suitability of the information contained on this website for any purpose. All such information is provided "as is" and with specific disclaimer of any warranties of merchantability, fitness for purpose, title and/or non-infringement. The Company makes no warranties or representations of any kind that the services provided by this website will be uninterrupted, error-free or that the website or the server that hosts the website are free from viruses or other forms of harmful computer code. In no event shall the Company, its employees or agents be liable for any direct, indirect or consequential damages resulting from the use of this website. This exclusion and limitation only applies to the extent permitted by law and is without prejudice to any express provisions to the contrary in any written license or subscription agreement from the Company in respect of the use of any online service provided via this website.
